Welcome to Find3000 (the "Platform" or "Find3000").

These Find3000 Terms of Service (the "Agreement") constitute a legally binding agreement between you and the operator of Find3000 regarding your access to, registration for, and use of the Find3000 platform and related services.

Before registering for, logging into, accessing, browsing, or using the Platform, you must carefully read and fully understand all terms of this Agreement, especially provisions relating to disclaimers, limitation of liability, payments, risk control, data usage, dispute resolution, and account restrictions.

If you do not agree to any provision of this Agreement, you must immediately cease using the Platform and related services.

By registering an account, clicking "Agree," using the Platform, or otherwise continuing to access or use the Platform, you acknowledge that you have read, understood, and agreed to be bound by this Agreement in its entirety.

1. Definitions

1.1 Find3000 Platform: Refers to the AI-driven networking and business matchmaking platform developed, operated, and maintained by Find3000, including but not limited to: Websites, Web applications, iOS / Android applications, API services, AI Agent systems, Third-party integration services, and any future products and functionalities launched by the Platform.

1.2 User: Refers to any individual, company, organization, or other entity that accesses, browses, registers for, or uses the Platform and related services.

1.3 Initiating Party: Refers to a party that initiates requests, searches for contacts, establishes cooperation, initiates communications, or purchases services through the Platform.

1.4 Contacted Party: Refers to an individual or organization identified, recommended, contacted, or otherwise receiving communication requests through the Platform.

1.5 Service Provider: Refers to a user who provides consulting, introductions, connections, cooperation, commercial services, or other professional capabilities to other users through the Platform.

1.6 AI Agent: Refers to the automated AI systems provided by the Platform, including but not limited to: AI-based contact discovery, AI analysis, AI recommendations, AI automated outreach, AI follow-up, AI intent recognition, AI data analytics, and AI automated communications. The behavior of AI Agents is jointly determined by algorithms, models, and user input, and does not represent the Platform's position or endorsement.

2. Nature of the Platform and Scope of Services

2.1 Nature of the Technical Services Platform: Find3000 is fundamentally an AI-driven information connection and technical services platform, providing information display, AI analysis, AI matching, AI recommendations, AI outreach tools, automated communication tools, payment-related technical support, data analytics tools, and API services.

2.2 Platform Is Not a Transaction Party: The Platform is not a party to any transaction, cooperation, consultation, employment, investment, service, procurement, or commercial relationship. The Platform does not participate in actual cooperation between users, does not provide substantive commercial services, does not participate in contract performance, does not guarantee transaction completion or authenticity of cooperation, is not responsible for transaction outcomes or user conduct, and does not provide guarantees, warranties, or endorsements.

2.3 No Intermediary or Custodial Obligations: Except where expressly required by applicable law, the Platform does not assume intermediary, guarantee, custodial, credit endorsement, financial intermediary, or payment institution obligations. Users are solely responsible for evaluating transaction risks.

2.4 AI Recommendation Disclaimer: AI recommendations, AI matching, AI intent analysis, AI outreach suggestions, and related outputs are for reference purposes only. The Platform does not guarantee accuracy of AI judgments, authenticity of recommended contacts, validity of business opportunities, accuracy of contact information, successful cooperation outcomes, responses from contacted parties, or absence of bias in AI analysis. Users shall independently exercise commercial judgment.

3. Account Registration and Identity Verification

3.1 Registration Requirements: When registering, users shall provide true, accurate, and lawful information; possess full legal capacity; and ensure compliance with applicable laws. If a user registers on behalf of a company or organization, such user represents that they are duly authorized to do so.

3.2 Account Security: Users are responsible for safeguarding account credentials, passwords, API Keys, verification codes, and login credentials. Any losses arising from account compromise shall be borne solely by the user.

3.3 Identity Verification and KYC: The Platform reserves the right to require users to complete identity verification (KYC) or business verification based on applicable laws, payment provider requirements, risk control requirements, anti-money laundering obligations, and anti-fraud obligations. If a user refuses to cooperate, the Platform reserves the right to restrict account functionality, delay settlements, freeze funds, refuse withdrawals, and terminate services.

4. Independent Contractor Status

4.1 Independent Entity: Service Providers are independent business entities. Nothing in this Agreement shall create any employment relationship, partnership, brokerage relationship, agency relationship, franchise relationship, or fiduciary relationship between the Platform and any Service Provider.

4.2 Independent Responsibility: Service Providers shall independently bear responsibility for service delivery, service quality, commercial commitments, tax obligations, legal liabilities, intellectual property liabilities, and regulatory compliance. The Platform shall not be responsible for service outcomes.

5. Payments, Fees, and Funds

5.1 Nature of Fees: Fees paid by users may include AI service fees, contact fees, token usage fees, platform commissions, API usage fees, subscription fees, value-added service fees, and third-party payment processing fees. The Platform reserves the right to modify its pricing and fee structure based on business developments.

5.2 Non-Custodial Statement: The Platform is not a bank, payment institution, custodial institution, financial institution, securities institution, or investment institution. User funds may be processed by third-party payment providers.

5.3 Third-Party Payment Services: The Platform may integrate with Stripe, Stripe Connect, Apple Pay, Google Pay, PayPal, Airwallex, bank card payment systems, and other third-party payment services. Users shall also comply with the terms and policies of such third-party payment providers.

5.4 Automated Revenue Distribution: In certain cases, funds may be transferred directly to Service Providers, the Platform may automatically deduct technical service commissions, and third-party payment providers may automatically process settlements. The Platform does not exercise actual control over user funds.

5.5 Collection and Disbursement Services: In certain jurisdictions or under specific compliance requirements, the Platform may facilitate collection and disbursement of funds. The Platform acts solely as a technical service provider and assumes no financial liability, investment liability, or credit guarantee obligations.

5.6 Withdrawals and Delayed Settlements: The Platform reserves the right, based on risk reviews, fraud investigations, user complaints, compliance requirements, or payment provider requirements, to delay withdrawals, conduct reviews, freeze funds, or reject withdrawals.

5.7 Non-Refundable Circumstances: Except where mandatory law requires otherwise, the Platform may refuse refunds when AI Tokens have been consumed, AI analysis has been completed, outreach requests have been sent, services have been partially fulfilled, users breach this Agreement, risk controls are triggered, or the Platform is used maliciously.

6. Tax Responsibilities

6.1 User Tax Obligations: Users shall independently bear and report all applicable taxes, including income tax, VAT, sales tax, business tax, corporate tax, withholding tax, cross-border taxes, and other applicable taxes and duties.

6.2 No Tax Advice: The Platform does not provide tax advice, legal advice, financial advice, or accounting advice. Users should consult qualified professionals.

7. AI Services Disclaimer

7.1 Limitations of AI: Users understand and agree that AI systems may contain hallucinations, errors in judgment, inaccurate information, data bias, model misinterpretations, intent recognition inaccuracies, and automation errors. The Platform does not guarantee that AI outputs are accurate or error-free.

7.2 Automated Outreach Risks: Users authorize the Platform's AI Agents to send emails, in-platform messages, automated communications, follow-up messages, and business outreach requests on their behalf. Users are solely responsible for ensuring compliance with local laws, anti-spam regulations, data privacy laws, and commercial communication standards.

7.3 Third-Party Data Sources: The Platform may utilize public or partner-provided third-party data. The Platform does not guarantee real-time accuracy, data accuracy, data completeness, or data legality.

8. Prohibited User Conduct

8.1 Illegal Activities: Criminal conduct, fraud, money laundering, gambling, illegal fundraising, terrorist financing, sanctions evasion, or illegal transactions.

8.2 Commercial Harassment: Malicious mass messaging, spam marketing, excessive harassment, false advertising, or deceptive solicitation.

8.3 Misrepresentation: Impersonation, false identities, fake demands, fraudulent transactions, false cooperation arrangements, or forged information.

8.4 Technical Attacks: Crawling attacks, API abuse, system intrusion, unauthorized data scraping, malicious API calls, DDoS attacks, or reverse engineering.

8.5 Unfair Competition: Circumventing Platform transactions, copying Platform business models, data theft, bulk exporting data, or building competing products using Platform resources.

9. Anti-Bribery and Anti-Corruption

9.1 Strict Prohibition of Bribery: Users shall not use the Platform for commercial bribery, government bribery, improper benefit transfers, kickback arrangements, illegal commissions, or concealed benefit exchanges, including disguised payments labeled as consulting fees, advisory fees, information fees, service fees, or referral fees.

9.2 International Compliance: Users shall comply with applicable laws, including the U.S. Foreign Corrupt Practices Act (FCPA), the UK Bribery Act, China's Anti-Unfair Competition Law, and other applicable anti-corruption laws.

9.3 Platform Enforcement Rights: If suspicious activity is identified, the Platform reserves the right to freeze accounts, delay settlements, restrict functionality, report to regulatory authorities, and permanently terminate services.

10. Anti-Money Laundering and Anti-Fraud

10.1 Prohibited Activities: Users are prohibited from using the Platform for money laundering, layered transfers, fake fund flows, cash-out schemes, sham services, or non-genuine transactions.

10.2 Risk Monitoring: The Platform reserves the right to conduct risk identification, transaction monitoring, abnormal activity analysis, KYC reviews, AML reviews, and manual investigations.

10.3 Risk Control Measures: The Platform may delay withdrawals, freeze accounts, restrict transactions, terminate services, and disclose information to regulators without liability.

11. Intellectual Property

11.1 Platform Intellectual Property: All Platform content (including software, AI systems, algorithms, UI designs, logos, data structures, APIs, documentation, and trademarks) is owned by the Platform or relevant rights holders. Without prior written consent, users may not copy, modify, distribute, commercially exploit, reverse engineer, or create derivative works.

11.2 User Content License: Users retain ownership of content they upload, submit, or enter into the Platform. However, users grant the Platform a worldwide, non-exclusive, sublicensable license to use such content for AI analysis, AI training, service optimization, recommendation systems, risk control, and product improvement, except where prohibited by law.

12. Privacy and Data Usage

12.1 Data Collection: The Platform may collect registration information, contact information, usage behavior, payment data, AI conversation content, device information, IP addresses, cookie data, and API usage data.

12.2 Data Usage: The Platform may use data for AI model optimization, recommendation system training, risk control, compliance reviews, customer support, product optimization, and business analytics.

12.3 Data Sharing: The Platform may share necessary data with payment providers, cloud service providers, AI service providers, compliance service providers, and regulatory authorities, provided such sharing complies with applicable laws.

12.4 Cross-Border Data Transfers: Users understand and agree that data may be transferred, stored, or processed in different countries or regions, and that data protection standards may vary by jurisdiction.

13–18. Additional Terms

13. Platform Risk Control: The Platform reserves the right to review users, refuse service, restrict accounts, remove content, delay withdrawals, freeze funds, and terminate services at its sole discretion, without prior notice, and without liability for resulting losses.

14. Anti-Circumvention: Users shall not circumvent the Platform by conducting transactions through private transactions, offline transfers, third-party platforms, or private contact methods where relationships originated through the Platform. Violations may result in liquidated damages, commission recovery, account restrictions, permanent bans, or legal proceedings.

15. Third-Party Services Disclaimer: The Platform is not responsible for third-party service issues (OpenAI, Anthropic, Google, Stripe, AWS, Cloudflare, etc.), including interruptions, errors, data loss, payment failures, or AI output issues.

16. Service Interruptions and Force Majeure: The Platform shall not be liable for failures caused by system upgrades, network failures, cyberattacks, third-party failures, regulatory requirements, war, government actions, international sanctions, natural disasters, epidemics, or power outages.

17. Limitation of Liability: The Platform shall not be liable for indirect damages, loss of profits, goodwill, data, business opportunities, investments, or customers. Total Platform liability shall not exceed the total amount paid by the user to the Platform during the twelve months preceding the event giving rise to the claim.

18. Information Disclosure and Regulatory Cooperation: The Platform reserves the right to disclose user information under legal requirements, court orders, regulatory requests, AML investigations, fraud investigations, national security requirements, or compliance reviews, without liability.

19. Dispute Resolution

19.1 Disputes between users are solely the responsibility of the users to resolve. The Platform assumes no arbitration obligations.

19.2 This Agreement shall be governed by the laws of the jurisdiction where the Platform operator is located.

19.3 Any disputes arising out of or relating to this Agreement shall be submitted to the competent courts in the jurisdiction of the Platform operator.

20–25. Supplementary Provisions

20. Updates and Amendments: The Platform reserves the right to update this Agreement at any time. Continued use of the Platform after updates constitutes acceptance of the revised Agreement.

21. Export Controls and International Sanctions: Users represent and warrant that they will not violate any applicable export control, economic sanctions, or trade restriction laws, and shall not use the Platform in sanctioned regions or provide services to restricted parties.

22. Minors: The Platform is not intended for minors. If discovered, the Platform reserves the right to immediately terminate services.

23. Language and Versions: This Agreement may be provided in multiple language versions. In the event of any conflict, the version designated by the Platform shall prevail.

24. Entire Agreement: This Agreement constitutes the entire agreement between the user and the Platform. If any provision is held invalid, the remaining provisions shall remain in full force and effect.

25. Contact Information: If users have any questions regarding this Agreement, they may contact Find3000 through official website, official email, in-app customer support, or official social media channels.

Final Statement

Users acknowledge that they have fully read this Agreement, fully understand its contents, acknowledge the risks associated with the Platform, voluntarily assume all related risks, and agree to be fully bound by this Agreement. This Agreement shall become effective immediately upon a user's registration, login, or use of the Platform.
